Our hosting platform features account creation and processes transactions. Payments made through our hosting portal are processed by our third-party payment infrastructure provider, Stripe, Inc. - Arbitration Rules:
Arbitration shall be administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules (for individual users) or Commercial Arbitration Rules (for business users), as applicable. A single arbitrator shall conduct the arbitration. The arbitrator’s decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.
- Location & Governing Law:
Arbitration proceedings shall be conducted in Weber County, Utah, unless the parties mutually agree to a different location or to conduct proceedings remotely. These Terms are governed by the laws of the State of Utah, without regard to conflicts of law principles.
- No Class Actions:
YOU AND CHROMATEK MEDIA SERVICES LLC EACH WAIVE THE RIGHT TO A JURY TRIAL AND THE RIGHT TO PARTICIPATE IN A CLASS ACTION, CLASS ARBITRATION, OR REPRESENTATIVE ACTION.
- Exceptions:
Notwithstanding the foregoing, either party may seek injunctive or other equitable relief in a court of competent jurisdiction in Weber County, Utah, to prevent the actual or threatened infringement of intellectual property rights or other irreparable harm. Small claims court actions that qualify under applicable rules are also exempt from mandatory arbitration.
- Costs:
Each party shall bear its own costs and attorneys’ fees in arbitration, except that the arbitrator may award fees and costs to the prevailing party as permitted under applicable AAA rules or Utah law.
